Centre bats for ‘Right to be forgotten’

Context
The Centre has told the Delhi High Court that the provisions of the Information Technology Act do not provide for the removal of court orders passed against a person on account of his right to be forgotten.
What is right to be forgotten?
- The ‘right to be forgotten’ or the ‘right to erasure’ is recognized as a necessary element of personal data protection laws.
- Simply put, it is the concept that individuals have the civil right to request that personal information be removed from the Internet.
- The Right to be Forgotten falls under the purview of an individual’s right to privacy.
Right to Privacy
- In 2017, the Right to Privacy was declared a fundamental right by the Supreme Court in its landmark verdict.
- The court said at the time that, “the right to privacy is protected as an intrinsic part of the right to life and personal liberty under Article 21 and as a part of the freedoms guaranteed by Part III of the Constitution”.
